Eviction Moratorium

On May 14th, Governor Ron DeSantis issued Executive Order 20-121, which extended the statewide moratorium on evictions for non-payment of rent due to the COVID-19 until June 2, 2020. It is important to keep in mind that if you are a "covered property" you will still have to abide by the federal eviction moratorium that lasts until late July. The governor issued Executive Order 20-123, which moves Florida into what the governor is calling "Full Phase One" of Florida's recovery. The order goes into effect today (Monday, May 18). Below is a brief summary of the items in this order that impact the apartment industry. For additional information regarding the other aspects of Full Phase One, please click here.

Executive Order 20-123:

  • Allows gyms and fitness centers to reopen at 50 percent capacity so long as they adopt safety measures including social distancing and have sufficient cleaning supplies. Gyms must comply with the Florida Department of Business and Professional Regulation (DBPR) guidelines.

  • Permits counties to seek approval to operate vacation rentals with a written request from the county administrator and the county’s safety plan for vacation rental operations, which must be submitted to the DBPR secretary for review.
